Erik H. Nelson recently obtained a dismissal for his client when the Court granted his Motion to Dismiss. Nelson had previously secured the dismissal of the same plaintiff’s claims against his client’s company after which plaintiff filed a second lawsuit against the co-owner of the company. The Court agreed with his argument that the lawsuit was barred by res judicata or claim preclusion and dismissed the lawsuit with prejudice. You can find a copy of the dismissal order here.
