Chad Knight represented BNSF in a FELA wrongful death lawsuit involving an employee of the Great Northern Railroad who worked as a telegrapher at its Libby, Montana, rail yard in the 1950s. The Plaintiff claimed that Mr. Hawk’s death was due to asbestos exposure associated with the railroad hauling vermiculite. The trial team demonstrated how the Great Northern was actually a leader in occupational safety issues as far back as the early 1900s, and the people who made up GN did not deserve any blame for Mr. Hawk’s death. The jury in Texas returned a defense verdict.
