Derek MacKay, Allison Greenfield, and Oliver Maguire of the Kansas City office recently secured a defense verdict for their client, Central RV, in the District of Kansas. The plaintiff alleged that Central RV sold a fifth-wheel camper to him without disclosing prior storm damage and that the camper was declared a total loss. Plaintiff argued to the jury that the failure to disclose was a violation of the Kansas Consumer Protection Act, fraud, and fraud by silence. Central RV denied the claims and argued that it fully disclosed all information available to the plaintiff prior to the purchase. After several hours of deliberation, the jury returned a verdict for Central RV finding no liability on all claims.
